double standard




i dont realy know what happen in darfur and maybe el bachir deserve to go to court,and be judges for his acts. but i know one thing israel been doing crims for 60 years and the International Criminal Court keep on ignoring it and this is the main reason why i think that there is no right for the international law to judge anyone because its alaw of double standard, let the sudanian people judge him.

let me explain this whole mess of laws and rights.. it is really complicated. Listen to who is to blame for this:

1. To be sewed in the International Criminal court you, as a state, have to ratify (accept) the Rome Statute. Of course israel did not ratify it: In 2002, two of these states, the United States and Israel, "unsigned" the Rome Statute, indicating that they no longer intend to become states parties and, as such, they have no legal obligations arising from their signature of the statute. So why would they do that if they have nothing to hide??

2. Also Sudan is not a state party from the ICC, therefor u would think they could not be sewed. But here the UN Security Council steps in. The UN Security Council can refer cases to the ICC. It did with Darfur: Article 13 allows the Security Council to refer to the court situations that would not otherwise fall under the court's jurisdiction (as it did in relation to the situation in Darfur, which the court could not otherwise have prosecuted as Sudan is not a state party).

3. Israel could therefor be sewed if the Security Council would refer the case to the ICC, even though Israel did not sign the treaty (the Rome Statute)
BUT: The Security Council is a UN body with 15 members. 5 of them are permanent and have the VETO right (to stop the majority by 1 vote) and... of course the USA is one of them. So exactly in the same way they block every resolution or punishment towards Israel from the UN, they also stop the prosecution of Israel by the ICC.

So the real warcriminals in this case, the USA and Israel, can get away with it.
So i think sewing Bashir is not wrong, neither has the ICC a double standard. Everything leads back to USA and Israel itself. They have the double standard. They have the whole world in their pocket and there is legally nothing anyone can do about it so far....

Just for anyones information..
It clarifies the situation, but does not make it more fair or just unfortunately. International law is arbitrary. And that sucks.

O yes, and also:
Even if there would be a chance to sew Israel by any miracle (let's say that USA would no longer support them)
There is no way to enforce International law upon states. there is no such thing as a 'world police' or something, unfortunately. USA likes to think it kinda is, but that is in this case not a good thing anyway.

So even though International law is binding, there is no one to check if states are being punished or held accountable.

So now u know the whole story. It sucks big time..
